1. General
In these general terms of use (hereinafter referred to as "Terms"), the following expressions have the following meanings: "User" means the company that uses the Platform for its transport operations. "Platform" means the transport exchange platform provided by this website, including all associated websites, applications, tools, features, and services available through that platform. "User Account" means an individual user account opened on the Platform to allow the User to access and use all the features and services available through the Platform. These terms apply to all types of platform use. By using the platform, you fully accept the Terms, even if you do not open a User Account. Access to the Services will not be possible if the Terms are not accepted in full. Users do not have the right to accept only part of the Terms. All Users agree that their personal data will be processed in accordance with the Data Protection Policy. The contract for the provision of transport services is between the transport company and the production/trading company, and the eTransport.ba platform is not a contractual party to these arrangements or contracts between them. In the event that the User does not comply with any of the established Terms, the eTransport.ba platform reserves the right to withdraw the User Account of that User and to suspend or deny all Services to that User without prior notice.
2. Subject of the Terms of Use
The subject of these general terms of use (hereinafter referred to as "Terms") is to define the terms of use of the transport exchange platform (hereinafter referred to as "Platform") provided by this website to the User, as a company that wants to use the services of this Platform for its transport operations. The Platform is an online service for connecting registered Users who post supply and demand for cargo transport. The Platform enables the posting and searching of transport offers and available vehicles and the exchange of offers between Users, but it is not a contractual party to the transport relationship, nor does it organize, contract, or carry out transport. The Platform operates exclusively as a passive electronic bulletin board on which Users publish and view listings on their own initiative and at their own responsibility. The Platform does not select, match, or recommend counterparties, does not participate in negotiations between Users, and does not take part in the conclusion or performance of any transport contract. By using the Platform, the User confirms that they are familiar with these Terms and fully agree with them.
3. Registration and User Account
The User registers to use the Platform by creating a User Account on the Platform and providing accurate and complete information about themselves and their company. The User must be a forwarding, transport, or production company to use the Platform. After registration, the User will receive a confirmation notification via email, and the registration will be reviewed and approved by the team managing the Platform. If the team rejects the User's registration, the reason will be provided to the User via the entered email or phone. The User is responsible for maintaining the confidentiality of their login credentials for accessing the Platform, including passwords associated with the User Account, and for restricting access to their account. The User agrees to notify us immediately of any unauthorized access, use, or suspicious activity related to their User Account.
4. User Obligations
The User is solely responsible for verifying the accuracy of the data and entries of third parties. Messages that users send and display through the eTransport.ba platform do not represent statements or views of the eTransport.ba platform, nor does the eTransport.ba platform approve or accept them as its own. The User releases the eTransport.ba platform from all liabilities arising from the use of the platform by the user that is not in accordance with this agreement. Additionally, the user releases the eTransport.ba platform from all claims and penalties from other users, authorities, or other third parties, which arise from the user offering or providing services through the platform for which they do not have or do not have sufficient prescribed permits, insurances, licenses, etc. The risk of non-transmission or incorrect transmission of data falls on the user from the moment the data leaves the influence zone of the eTransport.ba platform. The User is solely responsible for using their access to the platform, and any form of abuse is prohibited, as well as any attempt to upload information themselves, without authorization or through third parties, or to make requests in the platform system. In such cases, they bear the incurred costs, including the expenses of the eTransport.ba platform for device verification and/or expenses resulting from deficiencies and disruptions, which fall within the user's responsibility. The User must immediately notify the eTransport.ba platform of the possibility of unauthorized third-party access or other types of data security breaches that they have become aware of or suspect, as well as of any claims made by third parties against their use of the platform, and take all other necessary actions immediately. The User guarantees to the eTransport.ba platform that the employees they have engaged, or collaborators working for them, are employed in accordance with applicable legal conditions and releases the eTransport.ba platform from all liabilities, penalties, and reasonable attorney fees related to this. The User guarantees to the eTransport.ba platform that they provide their services at all times in compliance with the relevant applicable regulations and will promptly prove this with appropriate documents upon request from the eTransport.ba platform.
5. Platform Responsibilities
Neither the eTransport.ba platform nor associated sites provide transport and carrier services. The Platform is a passive bulletin board and communication platform for Users to arrange agreements. The eTransport.ba platform does not verify, and assumes no obligation to verify, the licenses, permits, insurance, or professional qualifications of carriers or any other Users; does not check the customs compliance or any other regulatory compliance of any shipment or transport operation; and does not guarantee the payment, solvency, creditworthiness, or performance of any User. Each User is solely responsible for verifying, before entering into any agreement, the identity, licenses, insurance coverage, creditworthiness, and regulatory compliance of the other party. The eTransport.ba platform does not collect, process, hold, or transfer any money or payments between Users. All payments for transport services are agreed and settled exclusively and directly between the Users, without any involvement of the Platform. The Platform does not act as a payment intermediary, escrow agent, guarantor, freight broker, or collection agent, and assumes no liability for non-payment, late payment, or any other financial dispute between Users. The Platform has no connection with transportation, destinations, or service fees that are agreed upon. The agreement for transport services is made between the Users of the platform, i.e., transport and production/trading companies. The eTransport.ba platform is not a party to any agreement or transaction between Users, and the platform is not responsible for any situation that may arise in connection with requests and offers for transport services between Users. The Platform does not act nor will it act as an agent for any User. The Platform is not responsible for any traffic accidents or traffic incidents. The Platform is not responsible for any disputes or incident situations that may arise between Users of the platform as well as between Users and third parties. Any violation of these Terms results in the immediate suspension of the User's account, and that User may be denied further access to all Services. The information provided in product descriptions, brochures, and user manuals provided by the eTransport.ba platform represents recommendations that are not binding. The eTransport.ba platform assumes no further responsibility. In particular, the eTransport.ba platform does not assume responsibility for the accuracy, completeness, and timeliness of information posted by other users, nor for the compatibility of the platform with the user's computer equipment or data transmission connections used. The User is aware that complex online platforms like the eTransport.ba platform, according to technical standards, can never be completely flawless. Therefore, the eTransport.ba platform does not guarantee complete absence of errors or appropriate availability, but only that the software on the platform will not have defects that would significantly impair the agreed use according to the contract. Changes to hyperlinks and information available on third-party websites via hyperlinks on the homepage and the eTransport.ba platform do not constitute part of contractual obligations nor serve to further explain those obligations. Editing hyperlinks and the content of pages accessible via hyperlinks is not constantly under the control of the eTransport.ba platform. For this reason, the eTransport.ba platform does not assume responsibility for the content or accuracy of that information. The Platform will not be liable to any User for any business, financial, or economic loss or for any consequential or indirect loss such as loss of reputation, loss of business, loss of profit, loss of expected savings, or loss of opportunity, resulting from the use of services provided by the eTransport.ba platform. The eTransport.ba platform has no responsibility in any case of material or immaterial damage nor responsibility for any accident such as death or other accidents. Given that the User is required to have valid permits for performing transport services and that the platform's service is limited to providing contact opportunities, i.e., connecting forwarding/transport and production/trading companies and cannot oversee any transport service, the User accepts that the aforementioned limitations of the Platform's liability are reasonable.
6. Fees and Payments
These Terms do not specify prices, payment methods, payment frequency, or any other details related to the User's financial obligations for accessing and using the eTransport.ba platform. All specifics related to fees for using the eTransport.ba platform, if any, are defined in a separate platform usage agreement between the eTransport.ba Platform and the User. The eTransport.ba platform does not charge any commission on transactions between Users and does not participate in any way in payments between Users. Any fee that may be charged relates exclusively to access to the Platform itself and never to individual transport transactions. All financial arrangements arising from transport agreements are settled directly between the Users concerned.

The eTransport.ba transport exchange platform provides services in good faith and with the aim of facilitating user connections for the purpose of exchanging transport information. However, the eTransport.ba platform expressly disclaims any liability for any losses, damages, or irregularities that may arise from using the platform. The eTransport.ba platform cannot guarantee the accuracy, completeness, or reliability of the information available on the platform. Users recognize that the information is provided by other users and third parties, and it is recommended that users use their own judgment and understanding when making decisions based on that information. The eTransport.ba platform is not responsible for any losses or damages resulting from reliance on that information. All transactions, agreements, and arrangements made between users through the eTransport.ba platform are solely between the users. The eTransport.ba platform is not involved in those transactions and does not assume responsibility for any losses, damages, or disputes that may arise from such transactions or agreements. The eTransport.ba platform strives to ensure continuous availability and reliability of the platform. However, the platform may be subject to technical interruptions, errors, or instabilities that may temporarily disrupt access or use of the platform. The eTransport.ba platform is not responsible for any losses or damages that may arise from such interruptions or errors.
